Kevin Smith brings over 20 years of experience to BBSW in providing high-level counsel to public agency clients contending with California's ever-changing energy markets. His primary areas of expertise include strategic legal and regulatory policy development and advocacy, power contracts, project agreements, balancing authority operations and inter-balancing authority agreements, as well as advising on matters of joint powers agency formation and operation, regulatory compliance and market design.
Kevin has extensive experience with novel and complex agreements and has had a hand in many firsts, particularly involving the California Independent System Operator (CAISO): the first Metered Subsystem Aggregator Agreement, the first Pseudo Tie Agreement, the first Market Efficiency Enhancement Agreement, and the first Approved Project Sponsor Agreement.

Prior to joining BBSW, Kevin was the Director of Energy Policy and Corporate Counsel for the California Manufacturers and Technology Association, Regulatory Program Manager for the Northern California Power Agency, and Senior Attorney in SMUD’s Office of General Counsel. He also worked as Senior Consultant to the California State Senate Energy Committee Vice Chairman during industry restructuring and as Minority Counsel to the Senate Judiciary Committee.
Kevin received his Bachelor of Science degree in Geology from San Jose State University in 1986. A Masters in Public Policy and juris doctor degree from Regent University in Virginia followed in 1994. Kevin is a member of the California State Bar.
